Discutir con los amigos es fácil. Es más difícil discutir con quien no comparte nuestros valores íntimos y preciados, con quien ofende nuestras creencias, deshonra nuestra fe y esperanza o se ríe de nuestras opiniones. ¿Cómo se ha de actuar en estos casos? ¿Con la espada y la ira en la mano, la indiferencia y el silencio, o el argumento y la palabra? ¿Y si no se puede ya razonar? ¿Cuando uno topa con el límite insalvable de la impotencia de (...) la razón se ha de acudir entonces a la potencia de la brutalidad? ¿Se puede, en breve, discutir con el “enemigo”? Este trabajo es un intento teoréticofilosófico por pensar analíticamente, modos de responder a estos interrogantes. Se busca examinar los límites, posibilidades y confines de la libertad de expresión, vista desde una teoría realista de la argumentación y de la pragmática del discurso normativo. Como ejemplos explicativos se toman conflictos generados por los grupos radicales, las sectas religiosas, los movimientos sociales violentos, entre otros. (shrink)

In this paper the authors deal with the story of Saman Abbas, an 18-year-old girl of Pakistani origin, who disappeared in Italy and was killed by her family after she refused an arranged marriage. The case raised a public debate between right-wing parties, who accused the left-wing parties of being culpably blind to the danger of Islam and too tolerant towards illiberal cultures, and left-wing politicians who responded equating Saman’s murder with the domestic killing of Italian women. We argue that (...) neither position does justice to Saman’s story. We hold that Saman’s case is an example of intersectional oppression where gender oppression is intertwined with the immigrant’s oppression in a Western democracy. Thus, we counter the dilemma posed by Susan Okin, namely that there is an inherent conflict between the rights of minority cultures and the rights of women. In order to rebut Okin’s position, we rehearse multicultural positions concerning the protection of minority cultures, on the one side, and feminist positions regarding the promotion of autonomous choice, on the other. Our conclusion is that (a) multiculturalism cannot be identified with cultural rights, and (b) that what are autonomous choices and what are, instead, adaptive is difficult to ascertain and, especially, difficult to apply in politics. Structural oppression is instead the key normative notion for addressing equality among genders and among citizens at large. The intersectional oppression suffered by women like Saman cannot be addressed by a restriction of toleration for immigrant cultures or simply by security measures. To prevent more cases like Saman’s in the future, the immigrant oppression should be taken seriously as well. In the context of fairer terms of inclusion, conditions of reciprocal trust between minority and majority may develop and the deconstruction of the patriarchal view of family can start. (shrink)

Neste ensaio, advoga-se a necessidade de se repensar as questões curriculares a partir da teoria da complexidade, justificando a importância desse instrumento para evitar a visão positivista de currículo, que separa disciplinas, fragmenta objeto do conhecimento, a realidade e a vida. Para tanto, são trabalhados os conceitos de currículo e de complexidade, reconhecida em seus aspectos ontológico, epistemológico e metodológico, bem como a importância da relação currículo/complexidade e alguns de seus possíveis desdobramentos em educação. Observa-se que a teorização complexa do (...) currículo ajuda a repensá-lo a partir da pluralidade cultural, da unidade na diversidade, da capacidade de produzir coisas novas no processo a partir de processos emergentes. Para tanto, considera-se a intersubjetividade e multirreferencialidade, reafirma-se a importância da alteridade, da luta pela afirmação das diferenças, bem como dos processos auto-eco-organizadores resultantes dos diálogos ocorrentes em sala de aula. O conhecimento interdisciplinar ou transdisciplinar decorrentes desta relação, em seus papéis formativo e elucidativo, são fundamentais ao mobilizar os processos de interdependência, de mestiçagem, de interfecundação e de religação de saberes. Assim compreendido, o currículo transforma-se no espaço da solidariedade epistêmica, da emergência e mudança de valores, diante da multiplicidade e heterogeneidade das experiências que requerem a superação da fragmentação disciplinar e a presença do diálogo constante. Ao finalizar, a autora ressalta a importância de se desenvolver, através das práticas curriculares, a reforma do pensamento proposta por Edgar Morin, a partir da inteligência da complexidade, como condição fundamental para superação da fragmentação do conhecimento e o encontro de soluções compatíveis à magnitude dos problemas atualmente emergentes. As more young people feel safe to outwardly identify as transgender or gender expansive (TGE), meaning that their gender identity does not align with the sex they were assigned at birth, an increasing number of youth who identify as TGE seek gender-affirming medical care (GAMC). GAMC raises a number of ethical questions, such as the capacity of a minor to assent or consent, the role of parents or legal guardians in decisions about treatment, and implications for equitable access to (...) care when differing parental or custodial viewpoints are present. These questions are further complicated by the difficulties in explaining the limits of long-term research in GAMC, with regard to the preservation of fertility, for example. We present two de-identified composite case studies to highlight dilemmas that may arise and offer recommendations to better support patient- and family-centered decision making for GAMC. These include employing a multidisciplinUniverary shared decision-making approach, disentangling informed consent and assent from chronological age, developing a consistent approach to the assessment of decisional capacity, and developing age-appropriate informational materials. Considera-se nesta análise que os educadores percebem a educação como um processo de libertação de toda forma de dominação, a partir do diálogo, do desenvolvimento do pensamento crítico, da construção coletiva do conhecimento, da práxis e do respeito aos saberes e as experiências de educandos e educadores. U podrucju manjinskih prava EU promovira norme koje nemaju uporiste u zakonodavstvu EU i koje nisu dio pravne stecevine EU. Limiti uvjetovanosti implementacije manjinskih prava koje EU promovira vidljivi su mehanizmu pracenja te implementacije, ukljucujuci i redovna izvjesca Evropske komisije o napretku zemlje ka EU koja prate manjinske probleme u politickom kontekstu neke zemlje. Izvjesca se baziraju na Kopenhagenskim kriterijima o zastiti manjina. Potrebni su ozbiljni napori u implementaciji zakonskih normi manjinskih prava. Nekoliko faktora utice na implemenatciju: konfuzija oko pravne (...) prirode zastite manjinskih prava, neodre?enost formulacije standarda i koristi koje bi njihovim provo?enjem neka zemlja imala. Kako svi ti faktori ne bi doprinosili daljnjoj nedorecenosti, EU mora ujednaciti i jasno definirati standarde manjinskih prava, uvjeravajuci vlade da postojanje manjinskih grupa obogacuje drustvo, a mjere usmjerene na ocuvanje njihove specificnosti utjecu na smanjenje rizika od konflikta.Iako se na primjeru Hrvatske moze vidjeti da su usvojene, promjenom zakonodavstva, mnoge evropske norme zastite manjina, iz izvjesca Evropske komisije najblize je moguce vidjeti i njihovu limitiranost, tj. ne primjenjivanje zakona u realnost. Izvjesca Evropske komisije o napretku prikazuju da manjinski problem nije prioritet EU u pristupnim pregovorima, te poteskoce EU u pracenju napretka u nedostatku jasno definiranih mjerila u podrucju manjinskih prava. Salas“For he doth not feign, that rehearseth probabilities as bare conjectures....”Sir Walter Ralegh, The History of the WorldThe Secret HistoryIn 1603 Sir Walter Ralegh was judged guilty of treason and imprisoned in the Tower of London to await execution. The wait was a long one —execution did not take place until 1618—giving this artful courtier, warrior, poet, and poseur time to script (...) new roles for himself. The most memorable of these was historian, and the stage on which he performed was the entire world. Universal history had been a time-honored genre in England, but never had there been so remarkable a performance by a native son as Ralegh’s The History of the World (1614). In five books Ralegh offered to king and country his interpretation of events from Creation to 168 bc. Book V, last and lengthiest of the entire work, deals in large part with the struggle between Rome and Carthage. The story of that struggle is Ralegh’s most mature historical writing and the most revealing of himself, for when he gave up his plan to carry his history into modern times, the Punic Wars became the context for things about the present that he was loath to leave unsaid.Despite its length (about a million words) and premature ending, the History was an enormous success with a public eager to possess the meaning of it all. Oliver Cromwell particularly liked the way it followed “the strange windings and turnings of Providence”; 1 no doubt he found Ralegh’s emphasis upon the Providential control of events reassuring. For Ralegh claimed to show how “kings and kingdoms have flourished and fallen, and for what virtue and piety God made prosperous, and for what vice and deformity he made wretched both the one and the other.” 2 In fact what Ralegh showcased [End Page 195] were the acts of a vengeful, Old Testament God more concerned with punishing monarchical sins than with making monarchs prosperous, and the History was temporarily suppressed by James for being “too saucy in censoring princes.” 3If the king did not like what he saw in the History, the king’s critics did; and Ralegh, never a friend to Puritan or republican in his lifetime, became a hero to both as a pious author and victim of Stuart tyranny. Those sympathetic to the Stuarts, like Alexander Ross, Chaplain to Charles I, saw Ralegh rather differently; but the popularity of the man and his History could not be denied. Ross himself profited from that popularity by doing both an abridgment and a continuation of the History as well as Som Animadversions and Observations upon Sir Walter Raleigh’s Historie of the World. Wherein his mistakes are noted, and som doubtful passages cleered (1653). Many of these animadversions were directed at Ralegh’s treatment of the Punic Wars. Ross recognized that “mistakes” and “doubtful passages” there formed a pattern: “Sir Walter cannot look upon the Roman Glorie with but a squint eye”(8), he complained. But did he also recognize the reason for that squint eye, that Ralegh kept one eye on the past and the other on the present? That many of those “doubtful passages” were in fact strategic elements in a campaign (based on parallels) against Rome, against James, and against James’s ministry? Had this been obvious to Ross, he still would not have said so. Writing under Cromwell, he could no more afford to complain explicitly about abuse of James than Ralegh, writing under James, could afford to make the abuse explicit.Parallels—implicit or imagined—are part and parcel of Ralegh’s providentialism. In brief: God controls events, God does not change, events do not change. Traditional expressivists want to preserve a contrast between the representational use of declarative sentences in descriptive domains and the non-representational use of declarative sentences in other areas of discourse. However, expressivists have good reasons to endorse minimalism about representational notions, and minimalism seems to threaten the existence of such a bifurcation. Thus, there are pressures for expressivists to become global anti-representationalists. In this paper I discuss how to reconstruct in non-representationalist terms the sort of bifurcation traditional expressivists were after. My (...) proposal is that the relevant bifurcation can be articulated by appeal to the contrast between relativistic and non-relativistic assertoric practices. I argue that this contrast, which can be specified without appeal to representational notions, captures the core intuitions behind the expressivist bifurcation. (shrink)

This paper aims to analyze Jürgen Habermas’s critique of liberal eugenics and why it should be stopped. For this purpose, the concept of liberal eugenics, its features and goals, postmetaphysics in Habermas’s philosophy, will be exposed, as well as the notions of Körper and Leib, which are three key elements that the philosopher presents to articulate his critique. Next, the importance of the naturalness of birth and reciprocal relations between individuals, and how they can be affected by genetic modifications, will (...) be explored to finally expose the measurements that Habermas proposes against the effects and consequences of genetic engineering. This article is concerned with Extreme Case Formulations in multiple-party TV programmes in two different languages: Spanish and English. I examine the role of ECFs in Spanish pre-electoral debates and in English panel interviews. English data is 77 minutes and 58 seconds long and comprises nine different panel interviews of political, socio-political and social issues and Spanish data is 78 minutes long and includes four political pre-electoral debates. The results will disclose that the number of ECFs found in the Spanish (...) and in the English corpora differs considerably. And in relation to the type of recording, the data will reveal that interviewers and interviewees deployed many more ECFs in political recordings than in socio-political or social recordings ; and politicians used more ECFs than any other type of interviewees. L’articolo illustra il modo in cui Dante ha utilizzato le fonti medievali nel campo dell’ottica e degli exempla dei bestiari per costruire analogie al fine di ragionare delle ricchezze e della nobiltà. Il testo analizza, in particolare, Purg. XVII 1-9, Cv. II iv 16-17, III vii, ix, alcuni frammenti della canzone Le dolci rime e il relativo commento in Cv. IV. Alla fine dell’articolo si espone il contrappunto filosofico che Dante offre alle vicende storiche del suo tempo.

Structural priming is a powerful method to inform linguistic theories. We argue that this method extends nicely beyond syntax to theories of meaning. Priming, however, should still be seen as only one of the tools available for linguistic data collection. Specifically, because priming can occur at different, potentially conflicting levels, it cannot detect every aspect of linguistic representations.

Este trabajo examina algunos de los valores epistémicos que la metáfora adquiere en el discurso científico, así como la importancia que esta estrategia cognitiva asume dentro de cualquier programa de investigación que defienda el privilegio epistemológico de la ciencia moderna.

The distinction between norms and norm-formulations commits legal theorists to treating legal norms as entities. In this article, I first explore the path from meaning to entities built by some analytical philosophers of language. Later, I present a set of problems produced by treating norms as entities. Whatever type of entities we deal with calls for a clear differentiation between the identification and individuation criteria of such entities. In the putative case of abstract entities, the differentiation collapses. By changing the (...) notions of the intension and extension of words by extensional and intensional aspects of what we talk about, I outline a methodological programme for Law and Legal Theory. Se realizó un análisis del proyecto "Acciones intersectoriales en la estimulación temprana del desarrollo del lenguaje" con el objetivo propiciar un estudio social sobre la gestión del conocimiento y la innovación tecnológica en la dirección de programas para la estimulación del desarrollo de menores en edad preescolar, desde la visión de ciencia, tecnología y sociedad. Se muestran conceptos afines al tema, necesarios en la comprensión de la idea de reorganización de los servicios vinculados a la estimulación y atención temprana del (...) desarrollo del lenguaje desde la comunidad, con la participación de profesionales de diferentes instituciones, y se demuestra la necesidad de comprender los estudios de Ciencia, Tecnología y Sociedad como un campo de acción en la actualidad en Cuba. An analysis of the project Intersectorial actions in early stimulation of the language was carried out with the purpose of favoring a social study of knowledge negotiation and technological innovation in the direction of programs to stimulate the development of children in preschool age at the vision of science, technology and society. Concepts related with the topic and necessary to comprehend the idea of reorganizing the services related with the stimulation and early attention of the language development starting in the community and with the participation of professionals from different institutions are shown. The need of comprehend the studies of science, technology and society as a field of action nowadays in Cuba is also demonstrated. (shrink)

Australian writer Carmel Bird writes fiction that, while being highly individual and varied, settles within the Australian traditions of both Peter Carey’s fabulism and Thea Astley’s humane wit. As William H. Wilde, Joy Hooton and Barry Andrews state, Bird is a “witty writer with a wide but always highly original tonal range”, who “raises what is often potentially sinister or horrific to something approaching comedy. Disease, deaths and violence are staples in her fictional world, which has similarities with Barbara Hanrahan’s (...) Gothic sensuality and feminist irony, although Bird’s deadpan humour is a distinctive, determining element”. The present interview focuses on an unexplored area in Bird—Andalusia, Spain—which, paradoxically, becomes the backcloth of some of her fiction—like the recent Child of the Twilight —and a prolific source of inspiration. The following pages explore Bird’s Andalusian/Spanish visions as regards nationalistic, religious, and cultural constructions. To that end, the theoretical communitarian discussion of figures like Ernest Gellner, Ferdinand Tönnies, Benedict Anderson, Jean-Luc Nancy and Maurice Blanchot will prove useful in the structural framework of this interview. Bird herself clarifies that her contribution is not offered from an academic perspective; she speaks about herself as a writer largely unaffected by academic bias. However, communitarian theorisation will prove useful in clarifying her depiction of nationalistic and religious values, while, in the process, she sheds some light on the slippery concept of “Australian writing” and the construction of Spanish cultural values from the perspective of an Australian writer. This interview offers a fresh rendition marked by the humorous, spontaneous and truthful tone that characterises Bird’s fiction. A pesar de la idiosincrasia de la narrativa de Carmel Bird, su producción se enmarca dentro de las tradiciones australianas del fabulismo de Peter Carey y la sabiduría humana de Thea Astley. Como afirman William H. Wilde, Joy Hooton y Barry Andrews, Bird consigue combinar el lado más siniestro con la comedia. La enfermedad, la muerte y la violencia son centrales en su ficción conectándola con la sensualidad gótica y la ironía feminista de Barbara Hanrahan, aunque el humor socarrón es un elemento distintivo y determinante en Bird. La presente entrevista cubre un aspecto inexplorado en la autora que, paradójicamente, se convierte en el telón de fondo de algunas de sus novelas y en una prolífica fuente de inspiración. Las siguientes páginas exploran el imaginario andaluz/español en su construcción nacionalista, religiosa y cultural. Con tal fin, las discusiones comunitarias de figuras como Ernest Gellner, Ferdinand Tönnies, Benedict Anderson, Jean-Luc Nancy y Maurice Blanchot serán el eje teórico vertebrador de esta entrevista. O presente artigo propõe analisar as concepções de Andrew Feenberg e de Richard Rorty em suas críticas antiessencialistas. Feenberg tem seu foco numa crítica às posições substantivistas e deterministas das tecnologias. Para ele, as tecnologias não são pré-determinadas por alguma natureza ou essência própria. Sua crítica coloca o modelo atual de produção e desenvolvimento tecnológico enquanto limitado pelos valores exaltados por grupos dominantes e que excluem a multiplicidade de valores em jogo numa sociedade. Já Rorty parte do pragmatismo para realizar (...) uma crítica às teorias de correspondência da verdade e das tentativas de fundamentar representações precisas da realidade. Ele aponta a imaginação, na concepção romântica, como a capacidade humana responsável pelo progresso social e como círculo dentro do qual a razão pode trabalhar. Essa noção de imaginação é, desse modo, o ponto de partida para novos modos do fazer e do desenvolvimento de potencialidades humanas. Este artigo buscou identificar um caminho de aproximação entre esses dois autores. Eles concordam quanto à necessidade de ampliação das possibilidades do fazer humano e de que concepções essencialistas limitam nossas potencialidades. A noção de imaginação, como apontada por Rorty, vai ao encontro da defesa de Feenberg pela ampliação do modelo de racionalidade que encaminha o desenvolvimento tecnológico, permitindo a democratização e ampliação das possibilidades humanas.
